Our policies have been updated to take account of the GDPR regulations which came into effect in May 2018. If there is anything in here that is not clear, then please contact us.

Our intention has been to lay everything out in plain and clear English so as to avoid any confusion and so that you can clearly understand what we do with your data.

The three most important aspects to us are this:

  1. We keep CVs on our database and we will always tell you that we have your details (your right to be informed) and with this we have a legitimate interest and a shared interest so that we can offer you new job opportunities.
  2. We will never send your CV or indeed any of your personal details to any third party without your consent to do so.
  3. You can ask us to delete your details any time and unless there is a legal or valid reason not to (in which case you will be notified in writing), we will do so within 0-72 hours (generally deleted on the same day as the request was made Monday to Friday OR within a maximum of 72 hours if the request is made for example after 5.30 on a Friday).

Information is provided on the J&C Associates Ltd website as a service and it is for general information purposes only. We reserve the right to make alterations on the website without notice however we will not make any changes to these terms without telling you.

General Data Policy

J&C Associates Ltd is registered with the ICO and exists for the purpose of providing recruitment services which could include introductions to companies, providing recruitment advise, strategy or consultancy.

Any visitor who submits information to the website warrants that the information provided is complete, true and accurate in all respects.

We will use your information, and the subsequent information we collect about you, to create a database. This database and the information it contains will be used by J&C Associates Ltd for the purpose of assessing your suitability, qualifications and skills not only for current work assignments but also for work assignments which we think may be of interest to you in the future.

We may also use your information to keep you informed by email, telephone, text or mail about future work opportunities, industry updates or any additional recruitment services which we consider may be of interest to you or to conduct research and compile reports.

By passing any personal data to us via this website you will have had the opportunity to read these terms and when applying for a job via this web site you will have ticked a box confirming that you have read our privacy policy. In addition, every email we ever send out from Outlook or our Recruitment Database also has a link to this privacy policy. If you do not want to receive any information from us then tell us when you next contact us.

All users acknowledge and accept that the use of this website shall in no event give rise to a partnership, employment or fiduciary relationship between you and J&C Associates Ltd.

All matters relating to the J&C Associates Ltd website and any disputes you may have with J&C Associates Ltd in relation to the website or services shall be governed by the laws of England and Wales, without regard to its conflicts of laws provisions. Any such dispute must be brought in the English courts located in the City of London.

Updated Terms and Conditions of the contract: your rights under GDPR

The idea with GDPR is for you (the data subject) to control who keeps your data and what they use it for.

It is also essential under GDPR that the policies are laid out in simple plain English and without ambiguity. We have therefore attempted to write one document without legal jargon which tells you everything you need to know. There may be some unintentional gaps and omissions but our intentions are as honest and as clear as they can possibly be.

J&C Associates Ltd is a recruitment consultancy and we only share candidate data as follows:

  • with companies or clients looking to hire new staff either for contract, permanent or fixed term roles and we will always ask for your consent before submitting your CV to any companies or clients
  • with third-party managing agents acting as an intermediary between J&C Associates Ltd and the end client and we will always ask for your consent before submitting your CV to any third party managing agents
  • with HMRC as required by law for quarterly reporting purposes for UK contractors only 
  • with our accountants Gerald Kreditor & Co for any auditing or accounting purposes or as required by law
  • with our insurers if requested and essential to getting insurance
  • with an umbrella company if you request us to do so with any other entity if legally bound to do so 

To be clear, save for the above, no candidate data of any type has ever been or will ever be shared with any other third party without your written permission.

Furthermore, no candidate data of any type has ever been or will ever be sold to any third party.

Your data is held safely and securely on a dedicated database that is only ever accessed by employees of J&C Associates Ltd.

J&C Associates Ltd will only ever use your personal data to send you recruitment related information and we will only ever send your CV to clients looking to review your details with a view to hiring you for a job and as above you will always be told where your CV is being sent.

When you submit a CV to J&C Associates Ltd, we will keep your CV on our database solely for the purpose of recruitment related activities.

This contract is between you, the data subject, and J&C Associates Ltd.

The contract is at the request of the data subject.

Your privacy is very important to us and we take it very seriously.

As a recruitment consultancy we have only shared COMPANY OR CLIENT data as follows (COMPANY is the name of the company and CLIENT is identified as the name of the client working for the COMPANY):

  • with candidates attending interviews with the company
  • with HMRC if required by law
  • with our accountants Gerald Kreditor & Co for any auditing or accounting purposes or as required by law
  • with our insurers if requested and essential to getting insurance
  • with an umbrella company if you request us to do so
  • with any other entity if legally bound to do so 

To be clear, save for the above, no COMPANY OR CLIENT data of any type has ever been or will ever be shared with any other third party.

Furthermore, no CLIENT data of any type has ever been or will ever be sold to any third party.

Who controls my personal data?

The Data Controller controls the data.

What is the legal basis and purpose of the processing?

Under GDPR any organisation processing personal data must satisfy at least one of six lawful bases for processing. At J&C Associates Ltd we have a legitimate interest in processing your data as this is necessary in order to provide our recruitment services and we will always consider and balance any potential impact on you and your rights under data protection and any other relevant laws. Our legitimate interests do not automatically override your interests and we will not use your personal data for activities where our interests are overridden by the impact on you unless we have your consent or are otherwise required or permitted to by law. Under these circumstances your right to be deleted remains intact at any time.

We are publishing this document so that you know your rights and so that you can at any time exercise your rights under GDPR.

We are a recruitment company so the purpose of processing data is in order to offer jobs to candidates and candidates to jobs. We therefore have to keep clear and accurate records of candidates in the market.

Your data or more precisely your CV will only be shared with companies or clients looking to hire new staff and we will always tell you where your CV is being sent and in this case we will absolutely rely on your consent which could be given orally, by email or by an online process. This consent will be recorded on our CRM system in use at the time. Where consent is the lawful basis for our processing you have the right to withdraw your consent to this particular processing at any time.

If you are a contractor, freelancer or sole trader who takes up a freelance role in the UK through J&C Associates Ltd, then your personal data will also be shared with HMRC as required by law as well as with the bank in order to authorise payments to you as well as with our accountants in order to conduct annual audits and possibly with third party intermediaries if such a company sits between us and the end client. In all circumstances you will be informed where your CV is being sent and you have the right to stop the process at any time.

Your data will not be shared with any other third parties under any other circumstances other than those detailed above and as required by law.

What data will the Controller collect and process?

The categories of personal data are your name, your job title, your company name, your company address and/or home address, your business email and/or personal email, your phone numbers and CV.

As described above, once placed in a role and most likely a contract role we will require further personal details such as bank details, NI Number and passport as well as possibly utility bills, VAT registration documents, insurance documents, certificate of incorporation, any resident permits or other proof of your right to work in the UK and where applicable Disclosure Scotland certificate or any other security or reference checking as required and where applicable by the client. We may request other personal data from you if required to do so by our client.

Personal Data may also include a link to a professional profile photograph if one is available in the public domain e.g. LinkedIn

We do not store computer IP addresses

Who will have access to the data?

J&C Associates Ltd staff will have access to the data.

HMRC will have access only to the data released to them on a quarterly contractor report.

Our accountants will have access to data as described above for reporting purposes.

Neither our accountants nor HMRC will at any time have access to our database.

Furthermore, we only work with GDPR compliant suppliers

Will the data leave the UK? If so, what safeguarding measures are in place?

Your data will only leave the UK if we are recruiting for an overseas client and your consent to release your CV to an overseas client will be sought just as it is for a client in the UK.

Any client we work with outside the UK will also be GDPR compliant.

How long will the data be kept for?

Our chosen retention period for personal data is 5 (five) years. We have chosen five years because it is a reasonable length time before your career can change significantly and we feel it would be necessary to re-confirm your situation if we have lost contact with you during those years.

Where we have lost contact with you and are unable to reach you or simply do not hear from you, J&C Associates Ltd will delete your personal data after the relevant retention period. However we will immediately delete your personal data when we are in receipt of a data subject's request to do so. Please note however that if you are working on an on-going contract through J&C Associates Ltd at the time when 5 (five) years has elapsed then we will naturally retain your details in order to keep paying you and in order to be able to contact you and to provide ongoing reporting to HMRC and our accountants. I think it is what one calls common sense.

Please also note that after the termination of your contract through J&C Associates Ltd we will retain your details for a period of 7 (seven) years from the end of the relationship to enable us to fulfil our record keeping obligations.

We will also retain your details if we are, for any legal reason required to do so and you will be informed of this decision and will be provided with the reasons as to why your data cannot be deleted.

What are your rights?

J&C Associates Ltd confirms the following rights to each Data Subject:

  • The right to be informed
  • The right of access
  • The right to rectification
  • The right to erasure which means you, the data subject has the right to change your mind and withdraw consent at any point during the retention period unless as above we are bound to retain your details for legal or record keeping obligations.
  • The right to restrict processing
  • The right to data portability
  • The right to object
  • Rights in relation to automated decision making and profiling.

You also have the right to lodge a complaint about the processing of your personal data with your local data protection supervisory authority (in the UK, the Information Commissioner’s Office).

Is there anything else you should know about how we use your data?

We may use your email address for the purposes of sending you relevant notifications about jobs or newsletters about the market.

We may process your personal data where necessary to enforce or defend legal claims, whether in court proceedings or in an administrative or out-of-court procedure. The legal basis for this processing is also our legitimate interests, namely the protection and assertion of our legal rights, your legal rights and the legal rights of others.

We may also process your data where such processing is essential for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another human being.

Client Data:

Client data held on our system also falls under legitimate interest and is a B2B relationship.

No client data has ever been shared with anyone other than candidates attending interviews or with our accountants or with any statutory or legal body as required by law.

No client data has ever been or will ever be sold.

Data Breach:

If there is a data breach we will report the breach to all those effected and to the ICO within 72 hours and we will record and investigate the incident internally and where necessary inform the police if there is a suspected theft data.

For clarity a data breach can include data loss.

And to be clear, to-date we have never suffered a data breach.

Amendments:

We may update this policy from time to time by publishing a new version on our website.

You should check this page occasionally to ensure you are happy with any changes to this policy though any significant changes impacting or changing your rights will always be emailed to you and the only real likely change to these terms will be when GDPR rules are updated or superseded.

Anti-slavery and human trafficking

Policy Statement

This policy applies to all persons working for us or on our behalf in any capacity, including employees at all levels, directors, officers, agency workers, seconded workers, volunteers, agents, contractors and suppliers.

J&C associates Ltd prohibits the use of modern slavery and human trafficking in our operations and supply chain. 

We have and will continue to be committed to implementing systems and controls aimed at ensuring that modern slavery is not taking place anywhere within our organisation or in any of our supply chains. We expect that our suppliers will hold their own suppliers to the same high standards.

Commitments

Modern slavery is a term used to encompass slavery, servitude, forced and compulsory labour, bonded and child labour and human trafficking. Human trafficking is where a person arranges or facilitates the travel of another person with a view to that person being exploited. Modern slavery is a crime and a violation of fundamental human rights.

We shall be a company that expects everyone working with us or on our behalf to support and uphold the following measures to safeguard against modern slavery:

We have a zero-tolerance approach to modern slavery in our organisation and our supply chains.

The prevention, detection and reporting of modern slavery in any part of our organisation or supply chain is the responsibility of all those working for us or on our behalf. Workers must not engage in, facilitate or fail to report any activity that might lead to, or suggest, a breach of this policy.

We are committed to engaging with our stakeholders and suppliers to address the risk of modern slavery in our operations and supply chain.

We take a risk based approach to our contracting processes and keep them under review. We assess whether the circumstances warrant the inclusion of specific prohibitions against the use of modern slavery and trafficked labour in our contracts with third parties. Using our risked based approach we will also assess the merits of writing to suppliers requiring them to comply with our Code of Conduct, which sets out the minimum standards required to combat modern slavery and trafficking.

Consistent with our risk based approach we may require:
